HC notice to Centre on banks’ coercive power
Petitioner has challenged power given to private financial institutions to seize property in lieu of unpaid loans

A bench of the Gujarat high court has issued notice to the Attorney General of India in a case concerning the sweeping powers given to private financial institutions for recovery of unpaid loans and advances.
The court issued notices while hearing a petition filed by one Harikaish Bhadoriya challenging section 2(1)(m)(iv) of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act-2002.
Bhadoriya’s counsels, Vishwas Shah and Massom Shah, have contended in the petition that the Central governmen t had issued a notification in 2007 given private financial institutions wide powers to recover their dues without interference by the courts.
The 2007 notification was issued by the Centre under the abovementioned section of the act and it gave 23 financial institutions, including Indiabulls, the power to recover unpaid loans by seizing property. The lawyers further submitted in court that the legislature had given unrestricted discretionary power to the Central government to pick and choose according to the notion of the individual.
Harikaish Bhadoriya’s property was seized and then sold by Indiabulls Housing Finance Limited. Bhadoriya had taken a loan of Rs8.25 lakh rupees but, when he defaulted, the private finance company had taken coercive action against him. The case is likely to come up for hearing at the end of February.
