  1. I’ve opened up a new thread. I am going to say this once again. the problem isn’t with political discussions but beating the same point to death. The political stuff shouldn’t drown out everything else. Similarly a 100 responses are not needed for every comment one doesn’t agree with. those who are primarily interested in political discussion might find their interests better served elsewhere.

    • My primary interest in this matter is indeed served better elsewhere. In fact I heaved a sigh of relief when I found out the thread was closed.
      I find myself in a fix here. I prefer not to discuss with opposing party supporters, (which is always BJP, because congress seems to have no supporters online, and there are so many of BJP on AAP pages, blog, fb etc) because they get very personal and abusive.
      On the other hand I feel disloyal if one sided stories come up, and I don’t post the other side.
      So I’ve decided not to comment on people’s views and opinion. Only when some information is wrongly portrayed, I’ll feel compelled to write it as it is.

      • OG, sometimes the problem is that on the other side you might have someone who will refuse to stop till he or she has the last word. And/or will keep going as long as necessary. if an argument is not about persuasion and debate even in the minimal sense and simply about each side repeating the same things over and over again it’s perhaps time to move on, either in terms of that subject or with a certain interlocutor. You should certainly participate in political discussions if these interest you. But in some cases ‘setting the record straight’ though it might be a reasonable objective will not get you very far if it hasn’t the first 68 times! Again the point I’m trying to make is you can keep discussing AAP or whatever interests you without necessarily falling in such a trap.

        I actually used to debate folks quite vigorously myself at points. Not all the time but when I got into a discussion often I would have a lot to say. Eventually I realized I had said everything I needed to on a topic. If people still kept saying the same stuff again and again I certainly could better use my time elsewhere. Now I never thought that everyone should accept my side of things. I am never into this sort of ‘conversion’ program. However any ‘debate’ to be even minimally possible must have two sides willing to agree on some basic facts. Even this was often not to be had. So one then has two choices. Either to keep saying the same stuff again and again or else withdraw. every now and then I leave a comment on political issues but for the most part I find it a thankless exercise.

        On AAP though I would accept they’ve made mistakes, created problems for themselves and certainly once you resign in politics it’s very hard to get a ‘win’ in any sense (barring some extraordinarily iconic figures who used resignations strategically).. all of this I can agree with but I still find most of the criticism to be rather cynical. Put differently the supporters of both Congress and the BJP should bury their heads in shame if they’re going to live by the same standards! But here there is the Aamir Khan analogy. This is precisely how many have attacked him for years, specially the SRK supporters. So when he wasn’t getting the biggest grossers he was attacked for being a fake and pretending to be serious when he couldn’t get the biggest hits. When he got the biggest hits the very same folks called him a sellout who confirmed just how fake he was. So he couldn’t win no matter what he was doing. The convenient logic was that since Aamir had set himself up to a higher standard he should be judged by that. This is true upto a point whether it’s about Aamir or AAP. However this hardly absolves everyone else from any sense of responsibility whatsoever! So the supporters of the other stars and/or political parties don’t get a free pass just because they’re more unscrupulous! Something analogous happens with the whole discussion on riots/pogroms. Mutually exclusive logical positions:

        1)The Right didn’t do anything
        2)Even if it did the Left did it first

        The problem is that each position here implies a very different ethical standard and/or logic. So the Left is all evil only till the point when the Left can be blamed for starting things first in which case it suddenly becomes the standard. So it’s not just politicians but equally defenders of political parties and movie stars who use the most cynical arguments to justify their positions. And then in turn refuse to budge and inch from their positions and keep quoting articles and opinion-pieces that simply confirm their views. It happens everywhere in life when ideological battle-lines are sharply drawn. It could be AAP or it could be Aamir, the same tactics come into play.

          Can Media and so called intellectual society or anyone from bollywood dare to ask him What happened to His protest ?           Now, Same project is biggest boon and life source of millions in Gujarat, Thanks to Narmada Dam and Solar energy plant over Narmada Dam turns out to be 180% efficient, also providing 24 electricity in villages of Gujarat which helped exponential growth in Agriculture development rate. And of course, it created thousands of jobs.
          Not just that, it resolved flood situation in gujarat.
          It was just friction of BJP’s 2 plan prepared in 2003.
          1) First plan was to connect all rivers of Country, control them with dams to avoid flood situation and drought situation in various parts balancing it out. And it helps generate power source.
          2) Quarter Express Highway project to Connect Metro cities via. express highway.
          Can Anyone ask Aamir why he wasted his time and fought for wrong cause of no consequence , or he did something to rehabilitate those people.
          Cheap Aamir, cheap Kejriwal and their followers.

          As for Lokpal Bill drama in Delhi assembly,
          1) Why Kejriwal didn’t give time other assembly members to go through lokpal bill. Didnt he already declared a week back he was going to resign ? While he gave copy of bill just 12 hours back to other assembly members. He already started drama without sending copy.

          2) Delhi already had got Lokpal bill introduced by centeral govt on 16th Dec. Lokpal bill is introduced by Central Govt, and Lokayukta by State Govt. Delhi also has lokayukta bill. Lokayukta bill was required to be modified for betterment. Instead, he used Lokpal bill as excuse. It was introduced by Central Govt , so he cant introduce Lokpal for state level defying Center Govt’s bill without Central govt approval.
          There were two ways to do it as per constitution-
          By taking advise of judicial matter advisory which AAP took from Soli Sorabji as per AAP’s statement. And either challenge Centre’s Lopal Bill it in court for modifying it for Delhi or send his own Bill to Lt. Governor to get it passed .
          AAP said Soli Sorabji advised unconstitutional route them to pass it without following of these ways which is unconstitutional.
          But, As per Soli Sorabji never said so, here is AAP exposed-

          Why BJP should let it pass unconstitutionally ? They have never done so and congress tried to do so once in 2002 (When BJP was in Central Govt and was in opposition in Delhi Assembly) but BJP forced them in Delhi assembly to take legal course in constitutional manner.
          Why should BJP reject constitution for AAP’s decision ? It is total anarchy. If they allow to AAP, That means every state will override central government laws. Every state will become separatist which is very dangerous and no different from what happens in Kashmir.
          Everyone knows AAP never respects constitution but BJP will condemn it and will never allow that.
          Problem is people don’t know these technicalities and AAP is misleading them by rhetoric. If Kejriwal’s intention were in right place he could have done without central govt’s approval, without Lt. Governor’s approval and without challenging anyone in Court.

        • This was just the introduction of the bill. At this stage a bill need not even be sent, just read on the floor, though in this case they received it at least 12 hours before the session.

          The passing takes place days later. That is when the members get plenty of time to read it, and discuss and argue over it.

          The opposition weaved a whole story about it being unconstitutional, whereas for ‘introducing’ a BIll things are not so narrow.

          The trick was to stop the Bill at the door and not let it be introduced because later if after discussion they voted against, they would look bad.

          Everyone knows that you can interpret laws to suit yourself (they are full of loopholes.
          If they were clear such confusions wouldn’t occur.
          Everyone interpreted the law as they wanted to including AAP.
          And of course the whole might of the opposition came down with all its power to show it as something wrong.

          To me the whole thing looks like someone knocked and stood at the door for entrance to be allowed in to say something, and was not heard leave alone even enter.

          AAP has always said the Lokpal Bill in the centre is not the one that the movement had drafted, and this was a much much stronger Bill. Even Anna Hazare is now saying that it was a pity the Bill could not be introduced and supports Kejriwal’s resignation.

            NEW DELHI: Former attorney general Soli Sorabjee has clarified that the legal opinion he had tendered to the Arvind Kejriwal government was purely on a procedural rule and not on the Jan Lokpal Bill.

            In Sorabjee’s opinion, Rule 55(1) of the Transaction of Business Rules is unconstitutional as there is no statutory bar on introducing a Bill in the assembly without the prior consent of the Centre. But then, as long as the Supreme Court does not strike down the rule, lieutenant governor Najib Jung is bound by it.

            The most that the Kejriwal government could have done with his opinion was to challenge the legality of the rule cited by the Centre for coming in the way of the Jan Lokpal Bill, Sorabjee told the media. Since it could not have taken the place of a judicial verdict, Sorabjee said his legal opinion could not override the rule that applied to Jung.

    • The cartoonist is ill informed because he doesn’t even know that Kejriwal never wears shoes. He always wears chappals or sandals (with socks) in winter. He even went to Rashtrapati Bhavan in sandals. Here’s a picture clearly showing his footwear.

    Following a Gujarat High Court order in December, the government has ordered all of domestically available compressed natural gas (CNG) for city gas projects to be equitably distributed among all the companies in the country. Prior to this, cheaper domestic gas was largely available to firms retailing CNG in Delhi and Mumbai.

    Indraprastha Gas Limited (IGL), which is the sole retailer of CNG in the national capital, hiked the CNG price on Dec 26 by Rs.4.50 per kg, saying the rate increase was forced by court orders that led to cut in allocation of cheaper domestic natural gas.

    The Delhi government in its submissions told the court that any reduction in allocation of CNG to the city would adversely impact prices of essential commodities as well as discourage the use of the clean fuel CNG.

    It argued that hike in CNG price is against the Supreme Court’s ruling, which had issued direction to convert the fleets of buses to CNG.

    The Gujarat High Court Dec 25 last year ordered cutting the allocation of gas supply and IGL implemented the changes in rates the next day.

    In its petition, the transport association said: “Supply/allocation would have a substantial impact upon the petitioner, as such reduction would mean that IGL would have to make shortfall from imported natural gas at a much higher price. The same would also be contrary to the Supreme Court order.”

    “Supply of domestic gas to IGL would be reduced from 2.344 MMSCMD to 2.228 MMSCMD, which amounts to almost a 5 percent reduction and translates to a reduction of supply of 1,16,000 standard cubic meters per day,” the petition added.

    The court, meanwhile, also refused to suspend the IGL’s decision to hike the CNG price.

    The city counsel told the court that the Supreme Court had asked the central government to give priority to transport sector, including private vehicles, all over India with regard to the allocation of CNG.

    “This means that first the transport sector in Delhi, and in the other air polluted cities of India, CNG will be allocated and made available and it is only thereafter if any CNG is available, that the same can be allocated to the industries, preference being shown to public sector undertaking and power projects,” argued city government’s counsel.

    “After use of CNG by the vehicles running in Delhi, there is considerable reduction in the pollution level into the pollution level figures of 1996,” counsel added.

    The Delhi government also supported the arguments of petitioner and said: “It is a hard fact that there would be an increase in the CNG prices as well as a result of the reduction of allocation of domestic gas in accordance with guidelines of Nov 14, 2013, issued by ministry, and an adverse economic impact on the commercial vehicles operators who got converted their vehicles to CNG by investing additional money on it.”

    It added that any reduction in allocation of CNG to Delhi would not only increase price of CNG alone but would have further impact on rising of prices of essential commodities as well as “discourage the use of CNG”.

    • There is also a tactical limitation that AAP faces, that other parties don’t: a Congress or a BJP can make alliances with the devil himself, and people will be somewhat forgiving, as no-one thought they were saints anyway. But AAP has put itself in a bind with Kejriwal saying things like (e.g. in his interview over the weekend with Barkha Dutt) that all the other parties are corrupt. All. While true, this does mean that AAP will find it difficult to credibly partner with anyone in the Lok Sabha, which could push them towards noisy irrelevance; or even expose them to attempts by other parties to depress voters by making the claim that a vote for AAP is a protest vote, without much practical significance.

      On the plus side, Kejriwal is a canny fellow, and has clearly tapped into the desire for “plainspoken” politicians; the Congress seems just about done, so I suspect any votes AAP garners in urban India will likely come at the BJP’s expense (which of course explains the stridency of BJP attacks on AAP of late). I don’t think his ride is over yet, but like Satyam, I do believe that the resignation is a big blow: in politics you are either in power or out of it.

      • AAP has always maintained that it will survive as long as people are motivated by its aims of removing corruption and the behaviour of elected leaders acting as Gods.

        Resignation was to let people decide whether they want to send them back with a proper mandate rather than the precarious and silly ‘outside support’.

        If people feel AAP failed, then so be it. Just to gain the chair/power by all means was never their aim.

        They wil definitely not make a noisy opposition as you claim, Qalandar.
        The dignity with which they sat throughout the session while the other two were creating such disorder and bedlam makes one hope that this will be their behaviour if they form an opposition.
        BJP was hands in glove with congress and so didn’t make a good opposition party which I hope.

        Anyway, the first list of 20 names have been announced and are really interesting. It also includes Soni Sori the tribal activist, Ashutosh against Kapil Sibal and other candidates against other

  7. While Indians fight with each other, China and Pakistan maybe feeling happy. There is this Arunachal Pradesh issue and for Pakistan the Kashmir issue.

    Congress maybe corrupt but now Supreme Court and vigilant political outfits are keeping a close watch on its every move and that may make them cautious. Somehow Congress will make another coalition this time too.

    Modi maybe good for the rich and the middleclasses, but what about the poorest of poor?

    Kejriwal must become alone crusader because some of his followers are bringing a very bad name. He cannot have the cake and eat it too. That is he cannot practice pure honesty and raise a political party too as the followers may turn out to be wolves in sheeps’ clothes.

      AAP will easily tie with Congress or for third front with Samajwadi Party after elections. Kamal farooqui , SP actually came to meet AK personally after he was appointed CM.
      SP of Mulayam singh provided Kejriwal z-security as long as he stayed at his Ghaziabad residence.

          NEW YORK : A US judge in New York has But Judge Brian denied Indian Congress President Sonia Gandhi’s request to strike down a Sikh advocacy group’s motion for the continuation of its human rights violation case against her, according to the organization’s press release.
          The February 11 motion of Sonia Gandhi pleaded that since the Sikhs For Justice have added new allegations of rights violation against her, and askedthe Court dismiss it.
          But Judge Brian Cogan denied the request“, saying, “If there is something wrong with plaintiff’s opposition, that’s what defendant’s reply is for”. The Sikh group accuses Ms. Gandhi for “shielding and protecting” the leaders of her party who were allegedly involved in the anti-Sikh riots in India in 1984.
          Gandhi’s New York-based counsel Ravi Batra said,
          “It is sad that SFJ has filed an ill-advised and misguided memo of law that violates basic legal rules that apply to every litigant. It will compel us to ask Judge Brian M Cogan for appropriate relief.”

          However, justifying the hearing, SFJ legal advisor Gurpatwant Singh Pannun argued that pursuant to US court orders on September 09, 2013, plaintiffs served the summons and the complaint on the hospital and security staff at Memorial Sloan-Kettering Cancer Center in New York where Sonia Gandhi was believed to have been undergoing medical treatment.

    • The problem with calling Hitler an ‘extreme aberration’ is that any level of violence in the same vein that does not rise to that level can automatically be dismissed as not serious enough. The Hitler label then becomes not a mode of vigilance but a way to enable ‘anything’! So it’s exactly the opposite of what Swapan Dasgupta claims. Of course with a little more understanding of history and a lot more understanding of philosophy he’d understand that the name Hitler is precisely important as a cautionary note. There have been all sorts of fascists in the history of the last century who were not Hitler in terms of what they did but who belonged to that same vein of political thought. The effects they unleashed were not acceptable just because they weren’t Hitler. The point of raising this name is precisely not to render Hitler as some way-out-there phenomenon from Mars! It is because that model is entirely replicable and has been replicated to varying degrees (only moral lepers wait for the numbers to reach 6m to find the analogy acceptable.. otherwise one need only count as far as 1!) since Hitler (and actually before Hitler too) that it is instructive to use it. This doesn’t mean one has to subscribe to the political use of ‘Hitler’ to serve various victimhood agendas. Nor does it mean one has to be blind to the same kinds of totalitarian violence when it occurs on the left (though it comes from different ideological corners the killing of millions is unacceptable when it’s Hitler who does it or Stalin.. but this shouldn’t prevent one from exploring the roots of each response.. there was a time when there were lots of left-leaning extremists in the world, we are now living through a phase when the right dominates in this sense.. the reasons for this would take long to explore and would constitute a different sort of discussion).

      Ironically in every such case where there were fascists propagating their new order (where of course the pretense always was that they were simply restoring the old!) they were all quite appalled when compared with Hitler in any sense. The Hitler signature has been made so sui generis that even if there were another leader exactly as bad as Hitler in every respect he too wouldn’t accept the comparison!

      Then there are the ‘crocodile tears’ in all these instances. The current Indian example is no exception. So it’s either that Modi didn’t do anything or if he did go get the Congress folks of ’84 first! So the Right also employs this move where it often pretends to be more liberal than the left (‘hey we’re only going to Afghanistan to save those little girls from getting their noses cut off’! It’s true that this can often be the result but that is not ‘why’ they really go). So here the bleeding hearts on the Right are so upset about the ’84 anti-Sikh violence (note by the way how the ‘Hindu’ is never evoked here.. who was doing the killing when it came to this minority? It’s only the neutral-sounding Congress) but forgot to bring it up until Modi was put on the stand (in a manner of speaking). Plus the ethical framework shifts completely when those two claims are made. If I find out a friend is a rapist I can hardly ‘defend’ him by saying ‘get last month’s rapist first’! And if one thinks that those on the left are being unfair to Modi why cannot one at least agree completely with Satyam who has been saying for years that whether it’s anti-Sikh violence or anti-Muslim violence or anti-Hindu violence all are equally unacceptable? Not just this, I have also said many times that I cannot condone retaliatory violence of any kind either (not an idealistic claim by the way..it’s the law in most countries I am aware of including India). It’s not enough to say ‘Satyam is fair, I have no problem when he says it’. I am not looking to create a club here, the debate is about whether what is being said is fair or not. Don’t give me a pass when it comes to this stuff, tell me whether you agree with the claim or not. If the latter why is it that the ’84 anti-Sikh violence is objectively true and that there’s no doubt about this whereas with 2002 even the most dispassionate reports from the most dispassionate researchers are never enough because somehow they have nothing better to do in life than plan hatchet jobs on Modi?!

      One sixth of the Indian population is tribal. It shocks many people to learn about this number. It’s roughly 150-200m people. In the languages of many tribes of central, eastern and northern Indian the word for Hindu is ‘diku’ which means ‘outsider’. For them these ‘adivasis’ or original inhabitants of India the Hindu is the outsider who came and took away everything. This ‘diku’ is ‘villain no. 1’ (if you’ll allow the Dhawanism) in their books. Once upon a time many on the right would have happily agreed being wedded to their Aryan mythology. However the strain that has prevailed insists (for obvious reasons) on a completely home-grown genealogy. The tribals disagree. of course the Dravidians too claim that they were here at least before the ‘Aryan outsiders’ but that’s another chapter of this debate.

      What’s the point here? That politics is often built on potent fictions but some fictions are ‘truer’ than others. The entire edifice of the Right in India is built on quicksand in every way imaginable (which does not mean it cannot be successful!). The question then is whether one retreats further into the mythology and increasingly finds oneself in an absurd positions where one is treating every bit of factual argument as implausible or if one is able to come up with a more responsible right-oriented discourse that doesn’t depend on such fantasy. History is always inconvenient for partisans on any side of any debate. It does not favor anyone. The problem lies in the ‘partisanship’. if you are invested in notions of religious or ethnic or national purity of any kind (not to mention gender..) history will defeat you. provided you have the courage to face up to it. The partisan always seeks ‘one’ version of events when there is always enough to complicate this picture.

      If one knows a South Indian language enough, certainly the major ones, one quickly discovers who deeply soaked each is in Sanskrit in terms of vocabulary and sometimes in other ways. It’s just a fact of life. One might not like the Aryan/Vedic colonization if one is into Dravidian nationalism, one might create a register of language less reliant on the Sanskrit but ultimately this history cannot be evaded. The same is true for those who don’t like British rule. To be Indian is to be minimally indebted to a British genealogy (we’re all writing here in English for a reason!). There is then the curious case of the Indian right-winger who is often invested in the most anti-Muslim political positions while being equally invested in the art and popular culture that is directly dependent on the same history! If one took a survey of BJP leaders one would run into Urdu-poetry enthusiasts far more easily than Hindi-poetry ones! Why is there this contradiction? Because one does not realize what has gone into one’s DNA before one was formed! In Tagore’s great novel Gora, the eponymous character is the right-winger of his age but a Desai-like twist reveals he is actually British. There are complicated historical currents that go into the lives of any community (national or otherwise) which in turn feed more individual identities. Political fictions are often dangerous because these often depend on a certain ‘forgetting’ or ignorance of the same.

      Ultimately the debate isn’t about Modi or whatever the left says. It’s about what one chooses to believe. the same happens on the other side. But we can’t only use this other side as a shield to avoid the consequences of our own views. I find the portrayal of Maoist violence in the Indian media to be completely misleading, irresponsible and de-contextualized. At the same time I also find the specific incidents of that violence to be atrocious and nauseating. I could say something similar about the LTTE (and this is in fact the tension explored in Ratnam’s film). One can hold on to both views. This does not prevent anyone from having one’s ideological sympathies or what have you. The question simply is: does the sympathy become so important that one is willing to sacrifice anything to preserve its (imagined) ‘purity’?

        • The problem is that a certain discourse that is structurally anti-minority (which is different from people being anti-minority at a personal level..) tends to mask it in the rhetoric of appeasement and so on. The latter itself is as old as the hills or if I might be allowed this example once more as old as Hitler! What I mean is that in every such situation the minority is always supposedly threatening the majority and the latter is only ‘defending’ itself. In every such example you could just substitute the names and the everything else would hold in exactly the same way. This has been my point repeatedly. You could take example after example and you’d simply have to fill in the blanks differently. The formula would be the same. The RSS youth exercises are modeled on those of the SS! People here might be appalled by the Hitler analogies. The RSS certainly isn’t! The entire Hindutva discourse borrows wholesale the lexicon on Western fascism. If you ask me the ‘Hindu’ today needs to be defended more than ever before from the ‘Hindutva takeover’. Sadly a lot of the damage has already been done but I’d say that from the Vedas to the Mahabharata and then down the ages into the contemporary present one of the urgent tasks in India is to rescue the normative Hindu (this was ‘the’ debate in Dev.. the normative Hindu in Bachchan vs the Hindutva type in Om Puri) from the violence of Hindutva. If there is a majority that’s forced to become silent here it’s precisely this kind of Hindu caught between a rock and a hard place. He or she can’t be Hindu in the old ways because this invites the charge of being right-wing and part of the Hindutva brigade. Being ‘secular’ would however be another forced choice. The point is that there is a certain tradition of Hindu religiosity, even bourgeois religiosity, that is not at all about this kind of militant Hindutva politics. Such people get it from both sides because from the secular left to the militant right they are considered questionable by each side. In India today the hardest thing in this sense is to be a Hindu who is not about Hindutva! Much as in different contexts the same might be true for Muslims and Christians and so on. Even within India this happens when you get the Mullah brigade going after more normative Muslims at various levels.

          To get back to the initial point I’ve often heard this refrain ‘hey I’m not anti-Muslim (or anti-Hindu or anti-black or whatever), some of my close friends are Muslims (or Hindus or Blacks…). The problem is that this proves the opposite of what the speaker thinks he or she claims. This establishes the essential bias or structural antipathy. Because you essentially hold up the friend as the exception to the rule. That is a personal choice. It’s like BJP leaders who have personal friends among the Muslim leadership, even at the Mullah level and even attend their Ramadan parties and so on. This happens everywhere. It doesn’t mean anything. In fact such a personal choices allows one to be even more anti-(whatever group it is) elsewhere because one can always keep the friend in one’s mind as evidence of one’s openness. So yeah all blacks are terrible but some are nice and they’re my friends! I am always willing to be friends with those exceptions!

I prefer market driven pricing but in India we have convoluted system. We pay more for petrol in form of taxes in spite of all lower prices elsewhere. Increased pricing is not going to help only Reliance, it will help other public sector companies like ONGC, OIL or whoever controls the rigs. The demand side include public sector companies which are major buyers of this gas and they have been opposing increase in the price. When Govt fixed the price, it was challenged in court. Why not the ONGC and other supply side player put in FIR? because Ambanis are easy target.

    This is not about Kejriwal or Modi. This is the rot which only ‘aam aadmi’ can take care!! India can never go to the next stage of advancement/development before corruption is rooted out.

    Now before that I also feel majority of Indians are at a point where they need to have a shot again with BJP/ Modi to douse the fire within (mann ki bhadhaas). This type of situation arose in mid/late 90s and everyone was getting crazy that bring BJP and all problems would be resolved and we would all have a Ram Rajya under Advani ji. However nothing of the sorts happened and its end became so haphazard that Congress was able to hold on to power for good 10 years after that. Also the collective false belief / apprehensions of Muslims populace that BJP/ Hindutva forces coming to power somehow meant their end was snuffed out and eliminated. So I definitely feel this thirst-quenching exercise must take place before AAP/ Kejriwal / aam aadmi can have a go at the real issues.

        On Bollywood what’s interesting though is the degree to which masala cinema often represented a kind of colonial world in this sense. It wasn’t just the stereotyping but the fact that the latter seemed truer to certain colonial realities than the present in which it operated. One might even say with only slight overstatement that masala (or more precisely the Desai ‘carnivalesque’ brand…) is already a certain form of nostalgia. And in this context Desai finally bringing Bachchan to British India in Mard is perhaps not entirely surprising. The point has been made by others that empires are often better breeding grounds for multiculturalism than contemporary nation-states. The Desai brand of masala cinema was a multicultural paradise of sorts and not surprisingly the director referenced the colonial past more than anyone else in the same (super)genre.

        • Here it would be interesting to track Bachchan’s own Pukar where he starts off being sympathetic to the Portuguese colonizer and actively ‘anti-Indian’ (in terms of the freedom movement) and eventually switches over (a move that is not very convincing in the film). Years later when Abhishek does DMD and returns to this site a mystery unfolds which has more masala and colonial contours than one might think (a point GF has always rightly insisted on). DMD’s Goa is of course very contemporary and very unpleasant in precise ways. It is not only mumbai but Hyderabad too during telengana and seemandhra agitations.   33. I think Kejriwal has shown that he is not capable of anything constructive and falling prey to same temptations that others have before. Several of these people who start of with ‘honorable’ intentions eventually start believing their coming to power and remaining in news is more important and that these ends are more important than the means. I pity the so called ‘intellectuals’ and ‘liberals’ who get sucked into supporting him because they are so angry towards Modi for his perceived championing of one religion or group. Their self righteousness blinds them to everything else.
    And, one has to feel sorry for the contortions they have to go through to defend Kejri or pull down Modi!
    In the end, voting right is an empowerment to be used judiciously and not an instrument to make a statement. I would any day take a chai wala who sees Modi for what he is worth i.e the only hope in these murkey waters inspite of his imperfections than an intellectual or a liberal who would enable Congress to return or embolden these joker.

  34. Btw, let me give an anecdote of Gujarat, the state that Kejri is trying his best to malign.
    Last week there was a Gulfood Fair in Dubai, which is one of the world’s largest annual Food Exhibitions. Happened to meet one Chilli merchant from the Eastern part of Gujurat, members of whose family are well-known Congress supporters from the Panchmahals. They were traditional Chilli traders, and used to buy from farmers in the Guj-MP border belt and distribute it around the state. So this guy, now has progressed to exporting Chillies globally, to as far as Mexico. Due to the various industry development schemes in Guj, he was able to get land allocated to open chilli processing units, and manufacture pizza-peppers and other related items globally. The state govt. has sanctioned land and infrastructure for farmers to be able to keep product in cold storage, labs to test the various features and certify export quality food, etc. So, he is able to gather chilli from Western MP, get it tested in labs in Ahmedabad, get them loaded onto trucks and ready in containers at the ports in less than 48 hrs. He said none of this would be possible had it not been for the excellent infrastructure development that has happened in the last decade under Modi. He does not deny issues, but states that net-net the pace and enormous scope of planning that has occured out there has lifted many many lives into prosperity, from the farmers he contracts with, to the transport companies, cold storage companies, labs, ports, etc. People who want to criticize industrialization can keep doing so, but the fact is one cannot even think of increasing employment without increasing the pace of develpment.
    Kejri can go on his smudge campaign, showing various angles of half-full glasses. But he will never be able to hide the truth on the ground, which real people in real situations are propagating out there.

  35. What we don’t understand is there is a vast difference between developing Gujrat and the rest of India esp the interior states of UP/ Bihar. Gujrat development is more a case of its strategic geographical location and vast access to coastline leading to heavy import/export access point to India with Persian Gulf, Red Sea, and Mediterranean and generally the West. It’s always been ahead economically due to natural deep drafted seaports and access to big ships. It’s also the hub of major oil/gas refineries which comes natural to the vast deserted land. With the rise of Ambanis and energy driven world in recent years most of these are controlled by people on the west coast mainly marwaris/gujjus. Even now most of the big gas carriers have access only in Guajarati seaports.

    Then there is fact that lot of Gujju wealth is NRI driven and the amount of money pouring in money transfers due to strong family network among Gujrati community.

    There is a certainly a desperation to bring Modi by a majority as he seems to be the last strong leader of a political party on paper. There is a big vacuum of leadership in BJP itself. Congress is all over the place. Manmohan Singh wants a way out of public life. Rahul is immature and more into coke addiction than problems facing India. So Modi remains the last hope for a lot of people.

The levels today are purely based on speculative confidence. The rupee has stabilized a bit because of manipulations (opening of second swap window and so forth) and also because Chidu has pulled wool over our eyes, by shifting major expenditure components to the next fiscal, thus artificially narrowing the CAD.     India is a country of different languages, different religions, the poor being the major chunk of the population who have their own political masters, caste and communal leaders and above all an activist supreme court.   37. Agreed there, but what’s irksome is putting Modi only as the poster boy of development and taking Gujrat as a model state. A lot many things are coming naturally to Gujrat and he is there in the right place at right time.

    I am one of the few who believe more than the governance it’s the corruption which is at the core of all the ailments. Stagnation in economy has taken place since we never went to next level in infrastructure development due to rampant corruption at all levels. Also more than the politicians it’s the white collared thieves who have ripped the country.

    BJP if it is in the same format as earlier will be no better esp. since it has a bunch of corrupt leaders in prominent position.

    Until now I am very pleased with AAP and Kejri as they have been instrumental in shaking the status quo at least.

    • Corruption off course is at the root of all ailments. But do not make the mistake of thinking that there is no corruption in developed countries. Kejriwal talks of a utopia which is non-existent. There may be some small homogenized population country (eg the Switzerland) where corruption is almost non-existent. But by and large it exists everywhere, in managed doses. It is omnipresent, the only difference being that in places like China or the West, things get done, which enable commonfolk to at least obtain basic employment. In India, the rulers take money and do not deliver, thus reducing the people to abject poverty.
      Modi works only because he has delivered, while keeping corruption in check. So people are ready to extrapolate his record in Gujarat to the pan-India level. One can never eradicate corruption, it is etched in the human psyche and simply impossible to eradicate.
      The video of his brother criticizing him actually proves that Modi is not given to nepotism like every other national leader. At least we know that he is not going to be personally corrupt. Without any family, who will he give the loot to?

        • And even after all this, there are people in the video saying that they get 24hrs electricity. He could not find a single slum out there. Everyone is living in brick-n-mortar houses in the poor areas. Yes, there are issues with garbage collection, broken streets in these poor areas, gutter drainage, etc. But does anyone realize how big a task it would be to totally revamp that infrastructure in the old areas of Ahmedabad? Where will the funds come for that? Gujarat gives a whole bunch of taxes to the center, but does not get a penny back in return. Its not like Nitish’s Bihar where he wants to make it a permanent-special-state receiving obscene amounts of funds from the center.
          And if you take a car ride from JFK through I678 towards the Whitestone Bridge, I bet one will feel he has landed in a mid-tier city in India, so bad is the condition of roads right here in NYC!

        Hitler became the Chancellor of Germany in January, 1933. Within a month, he invoked the emergency powers for ‘the protection of the people and the State’.   43. Panaji, Goa: Goa Police today told Bombay High Court that kin of Tehelka founder editor Tarun Tejpal, accused of raping a junior woman colleague, were showing CCTV footage related to the case to “everybody” in Delhi.

    “The CCTV footage is made available to Tejpal. The same footage is displayed to everybody in Delhi by the family members,” advocate Saresh Lotlikar, representing the state Crime Branch, told the Goa bench of Bombay High Court here.

    Lotlikar was arguing against the bail petition filed by Tejpal, who is currently lodged in Sada sub jail.

    The court has kept the matter for order on March 14.

    However, advocate Amit Desai, representing Tejpal, said the CCTV footage procured outside the lift clearly indicates that there cannot be a case against the accused.

    He rubbished the arguments that the victim was “way-laid, abused and taken advantage” by his client.

    Lotlikar said that if Tejpal is given bail, he will influence the witnesses and halt the process of trial.

    “Applicant (Tejpal) cannot be expected to be disciplined, if he is released on bail,” the lawyer said, in an animated one-hour arguments between defence and prosecution lawyers over the submissions.

    The prosecution said details of the calls made from the cellphone which was allegedly found in possession of Tejpal in the jail were also being ascertained. The calls were found to be made to persons in Gurgaon and Delhi.

    “The victim is already feeling traumatised. She has disclosed that messages are being circulated vilifying her character,” Lotlikar said strongly opposing the bail plea.

    The crime was a premeditated one because “it was repeated twice over,” he said.

    There may not be conclusive evidence against Tejpal, but the evidence is strong, he added.

    The prosecution sought to defeat the arguments that case against Tejpal was a political vendetta as the “entire charge sheet is based on the evidence collected through fair investigations.”

    “The CCTV footage clearly indicates that the girl was running behind Tejpal after getting down from the lift as against the claims made that Tejpal ran after her,” Desai said, adding that the “the girl was happy and held back no tears.”

    The footage also shows that the girl went into the lift with consent, Tejpal’s lawyer argued.

    Tejpal was present in the court flanked by his family members when the case was being argued.

    Desai said the complaint against Tejpal was an afterthought, which can be revealed through two emails written by the victim which has certain details added in the second mail.

    Pleading for bail, the lawyer said the CCTV footage contradicts the claims of investigating agency that Tejpal raped the girl.

Hence it is submitted that this Hon’ble Court must monitor further investigation/follow up of Mr.Y.P.Singh’s report. C. OTHERS.

    1.Between April 1990 and October 1995, RIL was alleged to have altered 70.30 lakh share transfer deeds, rendering them defective and incapable of being acted upon for effecting transfer In 1996, 29 criminal cases were filed by the Registrar of Companies Maharashtra. Summons were issued on 13.7.1996 by the Addl. Chief Metropolitan Magistrate Mumbai against Dhirubhai Ambani, his two sons and six others. No progress has been made thereafter. This Hon’ble Court has not yet looked into the matter and the same appears to have not progressed further. __________________________________________________________________

    5. The submission of the petitioner was that the alleged commission of irregularities in the aforesaid case was almost admitted even by the respondents in their counter affidavits on the basis of which they had investigated the matter and initiated proceedings. However, the petitioner was at pains to point out that the investigation and/or prosecution in all these cases were going at snail’s pace and in fact it was only after the progress was monitored by this court and orders were passed from time to time in this behalf, that the respondents speeded up the investigation and filing of charge-sheet in the court of law. Therefore, his submission was that the court should continue to monitor the progress of the cases.

    6. On behalf of the CBI, Mr. K.N. Bhatt, learned senior counsel had made the submissions. The CBI investigation relates to the issue of purchase of shares of RIL by the Unit Trust of India, and therefore, would be dealt with at appropriate stage when the said issue is being discussed.

    7. Mr. Vikas Mehta, Advocate appeared for the Enforcement Directorate and referring to the various affidavits including the last affidavit filed on 9th August, 2001 stressed about the progress being made in the investigations relating to various cases on the basis of which he submitted that since the Enforcement Directorate was itself looking into the matter, no directions need be given nor any monitoring was required by the court.

    8. Mr. Ashok H. Desai, learned senior counsel appeared for the RIL. With vehemence he opposed the present writ petition contending that it was a politically motivated petition filed by the petitioner who had leveled reckless and malicious allegations. These allegations were not only aimed at the officials of RIL and officers of some of the Government Undertakings, infact the petitioner had not even spared the PMO, Union Home Minister, former Chief Minister, Delhi and other such highly placed persons who were not even made parties in their personal capacity in the writ petition. Referring to such allegations against these high dignitaries in the writ petition. Mr. Desai submitted that sheer motive of the petitioner was to malign these persons and it was enough to expose the motives behind such a petition which was in fact not a petition in public interest. He also argued that as per the petitioner’s own showing in all five cases pointed out by the petitioner either the charge-sheet had been filed I the court or conscious decision taken not to take particular action or show cause notices had been issued. In such circumstances, according to the learned senior counsel, it was not appropriate for this court to give any directions at this stage as the court was not to issue such directions when the matter was pending investigation by the police or when the matter was pending before the appropriate court after the charge-sheet had been filed. To sum up, his submission was as under:

    a) There should not be any direction for prosecution of the case as that would affect fair trial and right of the accused inasmuch as if such direction is issued by a superior court, the trial court of competent jurisdiction would be influenced by such direction with lurking impression at the back of mind that the superior court has found some substance in the charge against the accused and that would not only affect the rights of the accused but fair trial of the case as well.

    b) When the matter was pending investigation by the police, the court would be slow in giving directions as the investigation was the demand of police authorities.

    c) Likewise, once the charge-sheet was filed in the court of law or appropriate authority had taken the decision one way or the other in a matter, or when show cause notice was issued for eliciting further information and was pending consideration at the level of appropriate authority, the court should not interfere in a Public Interest Litigation and issue any directions in the matter which was seized by the aforesaid authorities.

    The report filed before the Margao district and sessions court Wednesday by prison authorities also said a SIM card seized from Tejpal’s prison cell at the Sada sub-jail, 35 km from here, was registered in the name of a woman from a Panaji suburb.

    It said Tejpal regularly called Sheela Lunkad, who is Tejpal’s partner in a hospitality venture.

    Sheela Lunkad, Rajeev Lunkad, Tejpal and his wife Geetan Batra Tejpal are partners in a private limited company.

    The report added that Tejpal also called a woman called Manjiri, based in Delhi’s Saket area, at regular intervals, besides several other phone numbers in the national capital.

    “We are in the process of writing to the mobile service providers for proper contact details of the owners of these numbers. They will be included in the probe as to how the mobile phone was sneaked into prison,” said an official associated with the inquiry.

    The probe also revealed that the SIM card – bearing phone number 7350533170 – which was recovered from Tejpal’s shirt collar was registered under the name of Thereza, residing in Taleigao, a suburb of Panaji.

    Tejpal has denied possession of the SIM card, but was booked under various sections of the Indian Penal Code and of the Prison Act.

    A junior woman colleague has accused Tejpal of rape during a conference organised by the Tehelka founder in Goa. The woman said she was sexually assaulted twice in November.

    After an investigation, the Goa crime branch charged Tejpal with sexual harassment, wrongful restrain, rape, taking advantage of his official position, and committing rape in his custody.

        yes but it does not follow from everything you’ve said in your paragraph and even accepting everything (which I of course don’t) that because a Nehruvian vision has been ‘disappointed’ or co-opted and in ways that would have shocked Nehru, the only way then left is a Modi alternative. In fact one could easily make the claim that no matter how much Indira Gandhi’s excesses would have offended Nehru (I am not fan of her myself) or the extraordinary rise in corruption and so forth (though one must be careful not to define this only as an Indian problem. why is it that ‘corruption’ happens to be a serious issue in just about every ‘third world’ country or newly emergent economy or decolonized nation or… whatever label one prefers? there must be something more structural involved here if it’s a global issue.. it cannot just be that there are ‘dirty’ politicians everywhere!) the Modi alternative would have been absolutely anathema to him much as the whole Hindutva model would have been just about the most alien thing to his thinking (a man for whom even Gandhian religiosity was too much to digest and this when the Gandhian structure was itself very far from any notion of Hindutva in the politically militant sense). Put differently if one is a disappointed Democrat or Republican in the US that by no means implies that one jumps over to the other side. In other words one might want the Republican side or the Democratic side to ‘fixed’ (depending on one’s position) without wishing to migrate to the other side in the name of ‘efficiency’ or ‘better management’ or what have you. Now for some people who are much more on the fences politically (soft Republicans or soft Democrats.. it’s then a question of what the reigning issue of the day is) this sort of migration might work. It certainly is a phenomenon in every democracy. But in most Western democracies the stakes of the debate are in most historical periods far less sharply etched. It would not have made a huge difference in a structural sense even if Bush Sr had won in 1992. However it would have made for one if Romney had won in 2012. But by and large the Western model tends to be the 1992 one. In India on the other hand it’s usually something between 1992 and 2012 even if it isn’t always 2012.

        The question then might be: even accepting all of this what does one do as a practical matter if the choice is between the current Congress and the BJP? For me the choice is a relatively simple one. I would vote for the Congress. Even though I agree with almost all of the criticism directed against them. Why do I submit to this ‘blackmail’? Because I am completely certain looking at not just the historical record but everything that is happening elsewhere around the world today that corruption and cronyism and so on are not problems particular to the Congress. Can things still be better than they are currently on these fronts? Absolutely! But if the price for this difference in degree is to be paid with the kind of toxic politics (in my worldview) that the BJP provides (specially via a messenger like Modi) this trade is unacceptable to me. Much as in 1992 I could fathom a Democrat voting for Bush Sr. That wouldn’t seem to be an unreasonable choice but in 2012 I would consider the same option to be non-existent. Precisely because of what I would consider the extremism of the Republicans on most issues.

        So again even if I agree with you on everything with respect to your critique of Congress I still cannot subscribe to this fantasy of a BJP in power where all these ills magically vanish because Modi is a great administrator (assuming there’s no debate on this.. also something I don’t accept in an uncomplicated sense as I’ve gotten into before). There are always tradeoffs in politics. It might make me queasy to vote for this Congress and reward them in any sense but voting for the BJP would make me sicker still!

That the hole we are already in, will only get dug deeper. It surely cannot be deeper than what the Congress will anyway dig. So why give them a chance. A party with pitiable little to show for over the past 10 yrs cannot be given another 5 years to push us deeper into the abyss. If the BJP does the same, so be it, at least we wouldve tried and failed, rather than not tried an alternative at all.

          • I don’t actually have a pessimistic prediction here. I just don’t believe you get these sea-changes in areas that seem to be important to you (corruption et al) because these are structural ones. They don’t happen at the level of individuals. I also think that it’s rather naive to believe that if a system incentivizes corruption that one party would simply not engage in it! In the US Congress I don’t believe the Republicans are more corrupt in any essential sense even if I might not ideologically favor them. Or put differently there is an institutional corruption in American politics where both parties are quite happy to partake of it. You go to countries like Italy or Japan and every other party PM is implicated in a corruption scandal or worse. In the rest of the world similarly these issues occur on an epic scale. How is it then possible to believe that a BJP govt will represent a sea change? Are there differences in degree? Sure. But I don’t believe the difference in degree occurs at the kind of magnitude you’re thinking of. On the rest I talked about ideological differences that have to be part of the mix. So yes corruption might be no worse or even better under the BJP and given ten years it might not seem like a huge thing at this level but there will be other things that are. For instance the rewriting of history books and other kinds of textbooks to represent the worst kinds of ideologies and in ways that have nothing to do with a science (social or natural or otherwise). The BJP has already done this in states they’ve controlled at different levels. Much as in the US in states like TX ‘Creationism’ is taught as an alternative. Here it’s about basic protocols being reflected at the level of education. These are not inessential things. Whatever one’s beliefs one hopes that a school does not teach the Big Bang theory alongside an Adam and Eve one as comparable ‘theories’! There are all sorts of other essential things like social issues, constitutional issues, minority issues etc. So it’s not as if ten years doesn’t make a difference!

            The really amusing thing here is to a) find people who sometimes consider the Republican party (US) more harmful than the BJP! b) people who are otherwise very devoted to ideals of science and verifiability (almost to a fault) and various other freedoms indispensable in a US context and suddenly consider these very things expendable when it comes to India.

            ‘Corruption’ is a serious issue but one has to understand it in more serious ways. Beyond this corruption has always been the pet obsession of bourgeois classes in the subcontinent. Along with ‘efficient administration’. It’s not just in the subcontinent but really something common the world over. This is precisely what always opens the door to fascism. The fascist always promises both (efficiency, economic gains) and at least for a while delivers on them. The middle classes are willing to trade any value and any principle (I only exaggerate a little) as long as they can get trains running on time and less corruption! These things are important. I am hardly sneering at good administration. But there are things in life that are more important and of course ‘good administration’ itself should be understood more expansively. I’m not going to stir up a different debate here.

The wealthy GCC Arabs are distinct (even from one another), and they keep everyone else at an arms length.They have a clear pyramidal structure, in which the Royals are at the top, and the only empathy they have for their less fortunate Muslim brethren is exercised by a few gifts/alms (khairat). However, they will never let the sub-continental muslims have a place on the table.     Very well said and this itself begs for change of guard. Except Kejriwal and to an extent Nitish Kumar, have not seen any valid opposition to Modi since alternatives in Mulayam, Mayawati etc are worse off.

    Time is also ripe for the Hindutva forces to have one more shot at the helm and satisfy themselves for wanting to change the nation. The only minus here is it will hurt a bit more since desh ke naam par chori hogee. BJP should seriously throw Nitin Gadkari kind of people from the party but the opposite is happening with inclusion of Paswan etc ….there is chor written on his face like what we feel when we see sharad pawar.

    • As far as the chor-participants, there will be no difference as compared to any govt of the past 40 yrs. The only diff being that the guy at the top (ie Modi) is hellbent on creating a legacy for himself, as a sort of savior of India, who took India into the exalted league of nations.     • Again, the diff here is that this guy is a loner, with no one else to hand over the reins to. His own brother criticizes him, all he wants to do is prove that he is the next Kamal Ataturk or Deng Xiaoping. He has no other agenda, but to have praises showered on him for the developmental work he can do. There is no doubt that corruption will not stop, and a lot of development will go to crony capitalists. But at least there will be development, there will be infrastructure construction, roads, electricity, etc. The Cong was only busy lining its own pockets without any of these things.         After Kejri’s outburst against the media, even his own supporters in the media have started ignoring his rallies and statements. All these fabricated events have been done to keep his presence on TV going, but by now everyone has already figured him out. Actually, everyone is relieved that they not have a permanent Kejri countenance burnt on their TV screens.
        I feel really bad, this was one honest guy who just did not know the essential ‘chanakya-neeti’ of Indian Politics. He lost his way spectacularly in this muck, and possibly will drown in it. Hopefully he will learn from his errors and misjudgements, and concentrate on what really needs to be done to fix the system. First and foremost, please cut down on all the dramabaazi and actually deliver something worthy.
        Second, avoid the hardcore leftists in his group who advise him to freely distribute doles/sops without balancing the books. He really needs to embrace people who actually want to work to earn a living and pay their bills on time.
        Start with these two suggestions, and you will see how all the AAP support comes roaring back.

This Act was brought into force by Indian parliament after India became signatory to the landmark International Treaty ie, The United Nations’ Convention on The Rights of Child (UNCRC). The UNCRC prescribed that any person upto the age of 18 would be considered as a “child’. In compliance with the UNCRC, the Indian Juvenile Justice Act of 2000 also fixed the age of 18 as the age upto which every person in India would be considered as a child.

    After the unfortunate Nirbhaya gangrape incident in Delhi, there arose a raging debate on lowering the age from 18 yrs to 16 yrs in the definition of ‘child’. Also, whether those between 16 and 18 years should be dealt with by the regular criminal courts or juvenile boards was a point in question. These contentious issues were deliberated before the Hon’ble Supreme Court as well. The SC in an important judgement (Salil Bali vs. Union of India decided on 17th July 2013) upheld the fixing of age of a child at 18 yrs and also giving separate treatment to children in juvenile boards and not in regular adult criminal courts. Thereafter, the most recent judgement of 3 Judge bench (Dr. Subramanian Swamy v/s Raju Thr. Member, Juvenile Justice Board) headed by CJI P Sathasivam also decided on March 28th 2014 that under international law and Indian law, there is no scope for lowering the age of “constitutionally permissible” fixation upto 18 yrs to define a child..

    Very curiously, the person who is indulging in launching the highly defamatory attacks against Smt Nina Nayak was himself an appellant before the SC in which the SC categorically stated: “…we deem it appropriate to part with the cases by dismissing the appeal filed by Dr Subramanian Swamy …”.

    When the law says that a child has to be tried under the separate juvenile legal system and not in the regular adult criminal courts, if anyone, whether a member of National Child Rights Commission or a citizen respects the law settled by two recent judgments of the Supreme Court, one would be saying and doing what was and is legal and truthful.

      NEW DELHI: State-run Oil and Natural Gas Corp (ONGC) has told the government that gas production from some of its deep-sea fields would be viable only at prices of up to nearly $13 per unit, far more than the controversial price of about $8.4 that Reliance Industries would have charged from April 1 if poll authorities had not vetoed it.

      It has asked for prices of $10.72 to $12.63 for two blocks in the Mahanadi basin, close to RIL’s KG-D6 block, where gas has been sold at $4.2 since 2009. The government had approved a new formula in June 2013 that would have nearly doubled the rates but it could not implement it because the election code of conduct was enforced before the oil ministry could collected the necessary data to calculate the new price. The new price also faced strong opposition from the Aam Aadmi Party, which has made it an election issue.

      “The company may have to put its plan to develop these discoveries on hold till gas prices are raised between $11 and $13 per unit,” an ONGC executive said, requesting anonymity.

      Officials in the Directorate General of Hydrocarbons (DGH) confirmed that ONGC had sought higher prices for gas coming out of the two blocks. “ONGC has sought the help of the government because the project can give an IRR (internal rate of return) of 14% only if gas is priced at $10.72-12.63 per unit,” said a DGH official who did not wish to be named.

      ONGC and oil ministry did not respond to email queries from ET. According to government officials and company executives, ONGC’s Mahanadi project would not be viable even at the $8.40 per unit rate. “But, the new pricing formula is dynamic and changes every quarter. Sooner rather than later these discoveries would be commercially viable. Until then we have to wait,” the executive said.

  107. MUMBAI: The Hindi film industry, which prides itself on its secular image, appears to be taking sides for the first time during this Lok Sabha elections with some Bollywood “A-listers” asking people to vote “strategically” to protect the country’s secular character.

    Several celebrities including filmmakers Mahesh Bhatt, Imtiaz Ali, Zoya Akhtar, Vishal Bharadwaj, Kabir Khan, singer Shubha Mudgal and “Dhoom 3” director Vijay Krishna Acharya are signatories to the appeal which appeared to have divided Bollywood.

    BJP’s prime ministerial contender Narendra Modi is the butt of Congress’s unrelenting tirade over the Gujarat riots during the do-or-die election campaign with the issue of secularism dominating their discourse.

    Rajabali, however, insists the celebrities have not appealed to the electors to vote for a particular party or person or taking sides.

    “We are not asking or appealing to people to vote for a particular party or person, we are just saying vote for a person or party that is secular. We are not taking sides. Secularism is an important factor. It is the central character of our Indian society. We are appealing to people to keep this in mind while voting,” he told PTI.

    “It is not what we meant (anti-modi and pro-Congress), that is not the interpretation. We are appealing to people to vote for someone who is secular. Though majority of people in this country are Hindus but there are Muslims, Parsis, Christians and others as well. So one (party or person) should take care of everyone,” veteran filmmaker Mahesh Bhatt said.

    “We film people are citizens of this country and we are appealing to people to vote for the right person. If the BJP or anyone for that matter supports secularism I am with them. The idea of India is to protect everyone politically, economically and socially,” he said.

    The initiative by Rajabali and others, however, has not gone down well with many in Bollywood.

    “Shocking to see some colleagues, under garb of stopping so-called divisive forces, are themselves dividing a secular place like Bollywood,” filmmaker Madhur Bhandarkar said on Twitter.
    “Launching a personal attack on a man who has done more for his state than any other leader, reeks of conspiracy & unwarranted paranoia. Let’s hope better sense prevails and our film industry elects @narendramodi with a thumping majority. It’s time India got a visionary leader,” he said.

    Today in Mumbai Mirror I came across an article that says that a group has been founded by supposed like minded people from the Film Industry to go and vote for secular candidates and party. This kind of movement like propaganda has never been seen in the Hindi film industry. There have been several elections but the Bollywood fraternity never seemed to have bothered about campaigning for an “electoral cause”. What is strange is that this group who boasts of their secular agenda never raised a voice against the systematic cleansing of Sikhs in 1984, Kashmiri Pandit in 1990, Assam Riots in 2013 …. They have never raised or propagated their worries for parties like Samajwadi, Congress or any other political outfits known for their clear minority appeasing politics…. but all their veiled concerns are very much directed towards one party one man. If you feel so strongly against something one should have the spine to stand up and name the concern.
    People like Mahesh Bhat, Nandita Das have always been known to have singular apprehension for Modi and their heart bleeds, vocal cord opens only when it is about Modi… Bhat sahab’s family danced merry on the bleeding grounds of Muzzaffarnagar when the riot victims were freezing in open grounds… He went to Gujarat but never bothered to visit the riots victims of UP… May be because Modi’s name was not part of the rioter roaster.
    Maximum communal riots have happened in Congress ruled states and era but I have never seen Anjum Rajabali or a Nandita Das show their concern and pain for these riot victims… or is it that only these people hearts bleed if it is the victims of Gujarat of 2002… If the hatred and disdain is so strong… come out in the open and condone. One should take a leaf from super personalities like Rajnikant who had the spine to stand up and give a voice his convictions opens about Modi.
    Film industry as a body has never been a divisive force but such vested voices can cause an unnecessary divide. No other industry in this country understands the feeling of secularism than the industry wallahs… A stalwart like Salim Khan who though belongs from a minority… celebrates Christmas, Diwali, Ganpati in the same fervour that he celebrates Id with. This man had the guts to stand up and say that he is secular and supports Modi… He did not go around beating round the bush. If you believe in something don’t shroud your voice with hypocrisy…. your vested interests can’t be veiled in the veil of concern…

Interestingly, Robert Vadra’s mother Maureen Vadra has also been allotted two DIN numbers – 01840680 and 01839769.

          ection 155 of Companies Act 2013 prohibits any person have having more than one DIN. It says: No individual, who has already been allotted a Director Identification Number under section 154, shall apply for, obtain or possess another Director Identification Number.

          The situation was the same under Section 266C of the old Companies Act 1956, and is thus an established legal principle, which fact would have been known to the family chartered accountants.

          Section 159 of the Act posits six months imprisonment and a fine up to Rs 50,000, plus a fine of Rs 500 per day. It reads:

          If any individual or director of a company, contravenes any of the provisions of section 152, section 155 and section 156, such individual or director of the company shall be punishable with imprisonment for a term which may extend to six months or with fine which may extend to fifty thousand rupees and where the contravention is a continuing one, with a further fine which may extend to five hundred rupees for every day after the first during which the contravention continues.

          Section 152 (3) of the Act specifies that no person can be appointed as a director of a company unless he has been allotted a Director Identification Number under section 154. Clause 4 asserts that a person appointed as a director must furnish his Director Identification Number (DIN) along with a declaration that he/she is not disqualified to become a director under this Act. Clause 5 states that no person can act as a director unless he gives his consent to hold the office as director and such consent has been filed with the Registrar within thirty days of appointment in a prescribed manner.

          Section 155 explicitly states:

          No individual, who has already been allotted a Director Identification Number under section 154, shall apply for, obtain or possess another Director Identification Number.

          Section 156 reads:

          Every existing director shall, within one month of the receipt of Director Identification Number from the Central Government, intimate his Director Identification Number to the company or all companies wherein he is a director.

          It may be pointed out that Robert Vadra, a promoter director in 12 firms, has only one DIN number and his colleague, Amit Mehta, a director in seven firms, also has only one DIN number. Hence there must be some reason for Priyanka Gandhi seeking and receiving three DIN numbers, and an enquiry into the matter is clearly warranted. While it is fair to state that she would be unaware of the nitty gritty of the law, the excuse cannot extend to the corporate lawyers and chartered accountants who would have assisted her in the matter.

          This is a direct embarrassment for the Gandhi family, which cannot be wished away easily. It comes amidst the hottest contested general election since 1977, and comes close on the heels of allegations of a nexus between six new firms floated by Robert Vadra in 2012 and the realty major DLF, after an executive of the Group, Amit Mehta, gave the corporate email id as his email id in the relevant papers submitted to the Government. DLF has since distanced itself from the employee, who is a Director in five of the new firms floated by Robert Vadra.

          The Ministry of Corporate Affairs lists Priyanka Gandhi Vadra as a Director, with Active status in her husband’s company Blue Breeze Trading Private Limited, incorporated in November 2007, though she is said to have resigned as per information with the RoC, after getting hints about approaching controversies. She was also a Director in Rahul Gandhi’s Backops Services Ltd, which was closed down following media attention into its projects and income.

          An enquiry into Priyanka Vadra possessing three DIN numbers is serious because it raises the possibility of her involvement in businesses that do not reflect on the Ministry’s website.
