Salman to be charged with culpable homicide

The Bandra Metropolitan Magistrate Court has decided that Salman Khan should be charged with culpable homicide not amounting to murder in the American Express Bakery hit-and-run case. In September 2002, a car driven by the actor had run over a group of people sleeping on the pavement near his house, killing one and injuring four.

So far, Salman was being tried for the relatively lesser offence of causing death due to rash and negligent driving, which carries a maximum punishment of two years in jail. If found guilty under the new section (304, part 2 of the Indian Penal Code), Salman could be sentenced to a maximum of 10 years of rigorous imprisonment.

The Magistrate has directed Salman to appear before the Mumbai Sessions Court on March 11 for a hearing under the new section. Advocate Dipesh Mehta, representing Salman in the trial court, said they would challenge the trial court’s order in the Bombay High Court.

Salman had allegedly been driving his Toyota Landcruiser when drunk, and had rammed the vehicle into the bakery on Hill Road. He also ran over people who were sleeping outside the steps of the bakery.

Initially, Salman was charged causing death due to rash and negligent driving, but a few days later, following huge public outcry, the police added the charge of culpable homicide not amounting to murder and re-arrested the actor.

He remained in custody for 10 days before he was granted bail.

In 2003, however, Salman challenged the application of culpable homicide not amounting to murder in his case at the Sessions Court, and though it was rejected there, the Bombay High Court directed that charge to be dropped.

However, the Supreme Court did not agree with the view taken by Bombay High Court, and ruled that the Magistrate conducting the trial would be free to amend the charge if there was evidence to show he could be tried for a graver offence.

Following this, in October, 2003, the Metropolitan Court framed charges against him under Sections 304 A of the IPC (rash and negligent driving), 279 (rash driving), 337 (causing minor injuries), 338 (causing major injuries) and 427 (negligence).

On Thursday, Magistrate Vasant Patil observed in his order that “there is enough evidence to prove that the act was not incidental and was done with knowledge, therefore 304, Part 2 is applicable.”

The Salman Khan trial has been moving slowly, with only 17 witnesses examined by the prosecution since the trial began in 2006.

Recently, top cop-turned-activist YP Singh alleged that the cops investigating the case were helping Salman delay the trial by not producing the relevant witnesses in court.

There has been no movement since March 2011, when the prosecution moved an application before the Magistrate asking for Salman to be tried under enhanced charges of culpable homicide not amounting murder.

    oh please! now the government asks, a decade after the fact, what he should be tried for. it’s just a big song and dance. salman will die of old age before this reaches judgment stage. and you are overestimating our justice system, a lot, if you think a rich and famous movie star will ever be held responsible for anything.

    Film star Salman Khan, who ran his Land Cruiser (Mh 01 DA 32) over some pavement dwellers in Bandra, Mumbai, on Saturday morning surrendered before the Bandra police more than eight hours after the accident.

    Salman was taken for medical tests while his lawyer Waris Pathan secured bail in the Bandra police station.

    Earlier, in the early hours of Saturday, he drove his jeep over some people sleeping outside American Express Bakery on Hill Road junction in Bandra, Mumbai, killing one and causing serious injuries to three persons.

    The name of the deceased is Noor Ullah Khan (38). The three injured persons have been admitted to the Bhabha hospital. One has been discharged after being treated for his injuries.

    The deceased and the injured were employees of A1 Bakery and were sleeping outside American Express Bakery.

    Witnesses said Salman’s Land Cruiser was completely destroyed, and is at present parked in the Bandra police station.

    At the time of the accident, Salman was returning from the J W Mariott Hotel in Juhu and heading for his home in Bandra. He was accompanied by singer Kamaal Khan and Ravindra Patil, a bodyguard provided by the Mumbai police recently after the actor had complained of threats from the underworld.

    After the accident, people gathered at the spot and even beat up the actor, who fled from the spot along with Kamaal Khan.

    Patil, however, filed a complaint with the police. He has told the police that Salman was indeed driving the jeep.

    When police rushed to his house to question him, Salman slipped out through the back door, Assistant Inspector Nitin Yadav told rediff.com.

    The actor has been booked for rash driving and causing death due to negligence under sections 304, 279 and 388 of the Indian Penal Code. Salman can bail under all these sections, ACP Subhash Jadhav told rediff.com.

    The actor had been in the news recently for his stormy relationship with former Miss World and actress Aishwarya Rai.

    In an interview, Aishwarya Rai had admitted that she and Salman had split up in March this year and that the actor was unable to come to terms with the breakup.

    She had also alleged that Salman was hounding her and trying to cause himself injury whenever she refused to take his phone calls.

    Recently when Aishwarya was shooting for a film, Salman had reportedly landed on the sets and insisted that she accompany him. When refused, he had created a ruckus forcing the director to call off the shooting.

    So there is self-mutilation and obsession all involved …
    Actually for aishwarya (of that era) it was somewhat not that surprising—can empathise with him….. 🙂
